Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and SAMYCA LLC, a limited liability company organized in the United States ("Boosteate", "we", "us"), and govern your access to and use of the Boosteate mobile application and website (the "Service"). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Plain summary: Boosteate organizes your business finances and shows you information — estimates, your credit score, ways to obtain business credit. It is not a bank, lender, broker, tax preparer, credit‑repair organization or investment adviser, and nothing in the app is a guarantee of approval or a substitute for professional advice.

1. Eligibility

You must be at least 18 years old, reside in the United States and use the Service only for yourself or for a business you own or are authorized to represent. We ask for your date of birth at sign‑up to confirm your age (it is stored encrypted, as described in the Privacy Policy); providing a false date is a breach of these Terms and we will close accounts found to belong to minors. You may not use the Service if we have previously closed your account for breach of these Terms.

2. The Service

Boosteate helps self‑employed people, gig workers and small‑business owners to: track business expenses, receipts, income and IRS mileage; estimate quarterly taxes; organize debts and payment plans; track credit‑card sign‑up bonuses; view their credit score and factors; connect bank accounts to import transactions; and learn how business credit lines, including promotional 0% offers, work and what lenders typically look for.

3. Accounts, sign‑in and device security

You sign in with a one‑time code sent to your email or mobile number, or with your Google or Apple account. Each device you use generates a cryptographic key stored in the device's secure hardware, and that key signs your requests; a session is therefore tied to that device. You agree to:

We may require additional verification (a fresh code, biometric confirmation on your device) before showing or changing sensitive information. We may suspend an account when we detect signs of compromise, fraud or breach of these Terms.

4. Identity verification and credit report authorization

To show your credit score we need to identify you with a consumer reporting agency, which may require your legal name, date of birth, address and Social Security number. By tapping the authorization button in the app you provide written instruction under the Fair Credit Reporting Act (15 U.S.C. §1681b(a)(2)) for Boosteate to obtain your consumer report and score, solely to display them to you within the Service, and to refresh them periodically while your authorization remains active so that your history stays current. Each request is a soft inquiry that does not affect your score; a hard inquiry would require a separate, explicit authorization for a specific purpose. You represent that the information you provide is your own and accurate; providing another person's information is prohibited and may be a crime. You may withdraw your authorization at any time; see the Privacy Policy for how long we keep this data and how it is protected. Credit data is supplied by third‑party bureaus; if you believe it is inaccurate, you may dispute it with the bureau identified in the app. We do not guarantee the accuracy or completeness of bureau data.

5. Bank connections

If you connect a financial account, you do so through a third‑party data aggregator. You enter your bank credentials only in the aggregator's interface — never in Boosteate — and you authorize the aggregator to retrieve account information (institution, account names and masks, balances, transactions) on your behalf and share it with us. Access is read‑only; Boosteate cannot move money. The aggregator's terms and end‑user privacy policy apply to that connection and are shown before you connect. You may disconnect an account at any time in the app, after which we revoke our access token. You are responsible for complying with your bank's terms regarding third‑party access.

6. SMS verification messages

When you choose phone verification, you enter your own mobile number, check the consent box and tap "Send code". By doing so you agree to receive a one‑time verification code by SMS from Boosteate. Message frequency varies by usage (typically 1 message per sign‑in). Message and data rates may apply. Reply STOP at any time to opt out; reply HELP for help or email support@boosteate.app. We do not send marketing or promotional SMS under this program, and you can always verify your account by email instead. Carriers are not liable for delayed or undelivered messages.

7. Acceptable use

You agree not to: use the Service for any unlawful purpose or in violation of any financial, tax or consumer‑protection law; provide false identity or financial information; access or attempt to access another person's account or data; interfere with the security or operation of the Service, including by circumventing device‑binding, root or jailbreak protections, rate limits or encryption; reverse engineer, decompile or extract the source code of the app except where the law expressly permits; use bots, scrapers or automated means to access the Service; or resell or commercially exploit the Service without our written consent.

8. Fees

The Service is currently free. If we introduce paid plans, we will publish the price and terms in advance, and any charge will require your explicit acceptance through the App Store or Google Play billing system, which may have its own terms.

9. Your content and data

You own the data you enter or connect. You grant us a limited license to store, process and display it to operate the Service and, in aggregated or de‑identified form, to improve it. How we collect, use, protect and delete personal information is described in the Privacy Policy, which is part of these Terms. You can export your data and delete your account as described there.

10. Intellectual property

The Service, including its software, design, text and trademarks, belongs to SAMYCA LLC or its licensors and is protected by intellectual‑property laws. We grant you a personal, non‑exclusive, non‑transferable, revocable license to use the app on devices you own or control, in accordance with these Terms and the rules of the app store from which you obtained it. Names and logos of financial institutions, card issuers and bureaus belong to their owners and appear only to identify their products.

11. Third‑party services

The Service relies on third parties (identity providers, aggregators, credit bureaus, carriers, cloud providers). We are not responsible for their acts, omissions, availability or content, and your use of their services may be subject to their own terms.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT ESTIMATES, CREDIT DATA OR IMPORTED TRANSACTIONS ARE ACCURATE OR COMPLETE, THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR‑FREE, OR THAT YOU WILL OBTAIN ANY PARTICULAR FINANCIAL RESULT. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SAMYCA LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, INCLUDING TAX PENALTIES, INTEREST, DECLINED CREDIT APPLICATIONS OR LOSSES ARISING FROM RELIANCE ON INFORMATION SHOWN IN THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED US DOLLARS (USD 100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. These limits do not apply to liability that cannot be limited by law, including for gross negligence, willful misconduct or our breach of data‑protection obligations where the law so provides.

14. Indemnity

You will indemnify and hold harmless SAMYCA LLC from claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of law or the rights of a third party, or information you provide that is false or belongs to someone else.

15. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service, giving reasonable notice where practicable. Sections that by their nature should survive (data rights, disclaimers, limitation of liability, indemnity, governing law) survive termination.

16. Governing law and disputes

These Terms are governed by the laws of the State of Texas and applicable federal law of the United States, without regard to conflict‑of‑law rules. Before filing any claim you agree to contact us at support@boosteate.app and attempt in good faith to resolve the dispute informally for 30 days. Nothing in these Terms limits any consumer rights that cannot be waived under the law of your state of residence.

17. Arbitration and class‑action waiver

Please read this section carefully: it affects your rights. Any dispute between you and SAMYCA LLC arising out of or relating to the Service or these Terms that is not resolved informally under §16 will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small‑claims court or seek injunctive relief for infringement of intellectual property. The arbitrator may award the same relief a court could award to you individually. We will pay the filing and arbitrator fees for claims under USD 10,000 unless the arbitrator finds the claim frivolous. You and we each waive the right to a jury trial and to participate in a class or representative action. If the class‑action waiver is found unenforceable for a particular claim, that claim must be brought in court. Opt‑out: you may reject this arbitration section by emailing support@boosteate.app with the subject "Arbitration opt‑out" within 30 days of first accepting these Terms; opting out does not affect any other part of the Terms. The Federal Arbitration Act governs this section.

18. Changes

We may update these Terms. Material changes take effect only after you accept them in the app; we will show them to you at least 15 days before they apply, and the date above will change. Non‑material changes (clarifications, typos, updated contact details) take effect when published. If you do not agree with a change, stop using the Service and delete your account; changes to §17 may be rejected as described there without closing your account.
